Terms & Conditions

These Terms & Conditions (the “Terms”) govern your use of the Cubby app and this website (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service. Cubby is intended for people aged 13 and over.

1. Who we are

The Service is operated by Pavlo Seleznov, based in Ukraine(“we”, “us”). You can contact us at support@usecubbyapp.com.

2. The Service & pricing

Cubby helps you track your tools, the places you store them, and the friends you lend them to. The Service is currently free to use. If we introduce paid features in the future, we’ll present clear pricing and any additional terms before you buy — and any applicable consumer-withdrawal rights will be explained at that point.

3. Your account

You need an account to use most features. Keep your login details secure — you’re responsible for activity under your account. Provide accurate information, and tell us promptly if you suspect unauthorized use.

4. Acceptable use

• Don’t misuse, disrupt, or attempt to break the Service.
• Don’t use Cubby to store unlawful content or to harm others.
• Don’t attempt to access data that isn’t yours.

5. Your content

The tools, places, and notes you add are yours. You grant us the limited permission needed to store and display that content back to you and to the friends you choose to share with, so the Service can work.

6. Our intellectual property

The Cubby name, logo, app, and website are owned by us and protected by intellectual-property laws. These Terms don’t grant you any right to use our branding beyond using the Service as intended.

7. Lending & borrowing between users

Cubby helps you keep a record of tools you lend to or borrow from other people. Those arrangements are strictly between you and the other person. Cubby is not a party to them, never takes custody of any item, and is not responsible for the condition, return, loss, or damage of anything lent or borrowed, or for any dispute between users. Use your own judgement about who you lend to and what you borrow.

8. Third-party services

Cubby runs on infrastructure provided by Google Firebase. Your use of the Service also relies on your device and network, which are subject to their own providers’ terms.

9. Service availability

We work to keep Cubby available and reliable, but the Service is provided “as is” and “as available,” without guarantees of uninterrupted operation. Features may change or be discontinued over time.

10. Disclaimers & liability

To the fullest extent permitted by law, the Service is provided without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including any loss of data or inability to access your inventory. Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory consumer rights.

11. Suspension & termination

You can stop using Cubby and delete your account at any time. We may suspend or terminate access if you materially breach these Terms or use the Service unlawfully.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “last updated” date above, and for material changes we’ll take reasonable steps to let you know. Continued use after changes take effect means you accept the updated Terms.

13. Governing law & consumer rights

These Terms are governed by the laws applicable where the operator is established, without regard to conflict-of-laws rules. If you are a consumer in the EEA or the UK, this does not deprive you of the mandatory protections of your country of residence, and you may bring proceedings before your local courts.
